This page outlines the terms and conditions of EVIE KNOX. We highly recommend reading these terms before placing any orders, as purchasing from us signifies your agreement to these terms and conditions. The version of the terms and conditions that is in effect at the time of your order will apply to that specific order.

By placing an order with EVIE KNOX, you confirm that you are at least 18 years old (or have the permission of a parent or legal guardian) and that you accept these terms and conditions.

If you do not agree with these terms, you should not use the EVIE KNOX website or purchase any items. For clarity, it should be noted that you cannot accept these terms and conditions in part, unless otherwise agreed in writing between you and EVIE KNOX.

We assume no risk or liability and are exempt from all liability if you have not read these terms and conditions in full, even if permitted to do so.

Personal Information

As outlined in our Privacy Policy, all information you provide or that we obtain through other means is collected to ensure a smooth ordering and delivery process.

Payment

All products remain the property of EVIE KNOX until payment is made. We reserve the right not to send items if payment is rejected or if there are any other issues with it.

The price applied to your order is the one set on the day of purchase. Shipping costs are displayed before purchase confirmation. Your credit card information is not stored, ensuring a completely safe and secure payment process.

Delivery

Please be aware that customs/import fees are not included in our services. These fees are the responsibility of the recipient and are imposed according to the regulations of the destination country.

We are a customer-first company, and we strive to provide the best quality products with a seamless experience for you. However, sometimes things happen, so if there’s anything wrong with the item you have received, we will do our best to fix it and ensure you are satisfied.

Legal Right of Cancellation

You may cancel your order by contacting us at hello@evieknox.com.

Depending on where you live, you have a legal right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCRs”) or equivalent consumer legislation in the EU. This means that, during a certain cancellation period, if you change your mind or for any other reason decide you do not want to keep the purchased products, you can notify us of your decision to cancel the order. If you have already received your order, you will need to return the items you wish to cancel to us. Please note that all shipping expenses for returning items of good quality remain the responsibility of the customer.

If the order has been placed from a country outside the EU, additional fees such as customs or taxes may need to be paid for the return, and you are responsible for paying such additional costs.

IMPORTANT: Personalized products are one of a kind and have been manufactured specifically for you. Therefore, we cannot exchange or refund any customized products under any circumstances unless the product has a manufacturer’s defect.

Returned items must not have been worn or used and must be in their original condition; they will be inspected once received.

Returned items must retain their labels, but the return packaging does not need to be the original shipping one. However, it is your responsibility to ensure that returned items are properly packed to avoid damage during the return journey. If a returned item arrives in inadequate condition, we will return the item to you. In this case, we will not be able to proceed with the refund. Refunds for returned items will be issued to the original payment method used when placing the order.

If we do not receive your cancelled order, we may arrange a recovery at your expense.

If we notice an unusual pattern of returns activity, such as someone using their purchases and then returning them, ordering and returning excessive amounts of items, or the items returned not matching what was ordered, we might have to deactivate the account and any associated accounts.

Warranty

We are committed to selling items of excellent quality.

The items are guaranteed for the terms provided by applicable law.

Our quality guarantee does not limit or restrict your rights under applicable law in the event of purchasing defective items.

EVIE KNOX offers a warranty for a certain period on all items sold on our website. The warranty covers manufacturing defects. However, it does not cover failures or defects not caused by us or the manufacturer. No warranty applies if the defect or damage is due to negligence, external influences, natural wear and tear, or improper use and care.

The warranty will only apply if you have followed the instructions in our use or care guide for the specific product.

Use of the Website

You are prohibited from using this website for the following purposes:

• Breaching any laws or uploading unlawful, vulgar, or abusive material
• Interfering with others’ use or enjoyment of this website in a negative way
• Copying designs or other content that is EVIE KNOX’s intellectual property
• Using content uploaded by other customers without their permission

You must not misuse or tamper with the website, such as hacking, introducing viruses, trojans, worms, logic bombs, or other harmful material, carrying out denial of service attacks, or otherwise interfering with EVIE KNOX’s technology or functionality, or stealing EVIE KNOX’s customer data.

You are also prohibited from using automated systems or software to extract data from our website.

You will be responsible for EVIE KNOX’s losses if you breach these provisions. You also agree to indemnify, defend, and hold harmless EVIE KNOX, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, and/or costs (including legal fees) arising from your use (or misuse) of this website or your breach of these terms.

We do not warrant and shall not be liable if the website is unavailable at any time. You acknowledge that EVIE KNOX is not responsible for internet access services.

Reviews on Our Website

If you have purchased items from the website and meet the other requirements set out in this section of the terms, you have the right to evaluate the purchased items by leaving a review on the website.

We take no responsibility for the content you or other buyers submit, post, or display on or via EVIE KNOX’s website.

We undertake to comply with the requirements of applicable law, these terms, and the Privacy Policy when collecting and publishing your review.

We reserve the right to change, amend, or supplement these terms and conditions at any time.

Limitation of Liability

We are not liable for any loss or damage caused by your use of the purchased items if the use of the product does not comply with what is set out in any applicable user guidelines and care guide and/or if the items are not handled with proper care. You are responsible for examining the items to ensure they are not defective prior to use.

Our liability for any loss or damage arising in connection with your order on our website is limited to the value of your order, unless otherwise stipulated by mandatory law. We shall under no circumstances be liable for indirect losses or indirect damage.

Intellectual Property Rights

All content of the website, including all texts, graphics, images, photographs, any footage or visual material/recordings, trademarks, logos, other visual signs, illustrations, graphic design of the website, software code and/or individual parts of all of the above-mentioned objects, domains, etc. (hereinafter referred to as the “EVIE KNOX’s Content”), is our or a third party’s intellectual property, which is protected by the laws and international legal acts regulating copyrights and intellectual property rights.

By accepting these terms, you understand that by using the website and purchasing items, you do not acquire any rights to the EVIE KNOX’s Content and may only use the EVIE KNOX’s Content in accordance with these terms. You shall not use the EVIE KNOX’s Content, including but not limited to, publishing, selling, renting, copying, displaying, modifying, adapting, reproducing, and using it in any way other than solely for personal and informational purposes without the consent of EVIE KNOX or the third party holding the relevant intellectual property rights.

If you infringe on our intellectual property rights, you shall be liable to compensate for damages resulting from such infringement.

EVIE KNOX shall not be liable if you do not receive the sent information or confirmation messages due to internet connection issues, network disruptions of email service providers, messages sent to the SPAM folder, or incorrect data provided by you.

Dispute Settlement and Applicable Law

These terms and the purchase of items shall be governed by the laws of the United States of America. Any disputes arising from these terms or the sale of items shall be settled and referred to the competent courts of the United States of America. Please note that we may initiate legal action in the territory where the buyer has a permanent residence.

If you have a complaint, you can outline and submit it to us using the contact information specified in these terms. We undertake to respond to such claims within 14 (fourteen) calendar days from the date of receipt of the request.
